The Obama administration Congress has publicized that their newest proposal to spare homes from bank foreclosures is by boosting mortgage modifications. This is termed the Home Affordable Modification Program or HAMP. The Home Affordable Modification Program was made for the purpose of generating broad parameters for the mortgage industry on reworking loans. The Home Affordable Modifications Program (HAMP) is also designed to deliver enticements to lenders and servicers to be amenable to modifications.

As with most of the federal foreclosure help programs, taking part in the Home Affordable Modification Program (HAMP) is, for many lenders and companies which provide service, voluntary. Many of the biggest suppliers of service have signed contracts of agreement to take part in the Home Affordable Modification Program (HAMP). Under the Financial Stability Plan, institutions which have obtained finances from the government are required to take part in the Home Affordable Modification Program (HAMP). This is in conjunction with Freddie Mac and Fannie Mae.

According to freddiemac.com, one main advantage of benefitting from the program is that it fundamentally obliges mortgage servicing companies who are participating in Home Affordable Modification Program (HAMP) to evaluate the homeowner's loan adjustment eligibility before being able to conduct a sheriff sale. Mortgage servicers who are part of the Home Affordable Modification Program (HAMP) plan are discouraged from commencing the process of foreclosing homes until a complete assessment has been made, and debtors are deemed ineligible for a mortgage modification.

The Home Affordable Modification Program (HAMP), according to hmpadmin.com, requires loss mitigation endeavors. The parameters for loss mitigation are not unlike those which are mandatory for FHA loans. In the situations of an FHA loan default, the mortgage servicer is expected to confer with the debtors for a different option to losing the house. This is similar to the Home Affordable Modification Program (HAMP), since both strategies are created to assist homeowners and as much as possible, keep them in their homes at a manageable rate.

Largely due to this program, homeowners are now able to reveal new defenses to foreclosures from servicing companies or lenders inability to stay within the program's parameters.

One example is that if a lender participates in the Home Affordable Modification Program (HAMP) but does not do a thorough review of the borrower's financial statements to decide whether modifications are a possibility, the foreclosure will not push through. Failure to comply with HAMP parameters before the event of foreclosure may possibly mean that homeowners are not in default of the mortgage agreement.

Congress has declared HAMP parameters to become the "standard industry practice for purposes of all Federal and State laws." This entails that a servicer's failure to abide by the regular industry practices will need to create a foreclosure defense which homeowners can use in court. Lenders are now allowed to follow HAMP guidelines unless forbidden by the servicing management itself.

Hence, due to the new Obama administration regulations, homeowners now have additional resources in order to qualify for a loan modification and subsequently save their home from foreclosure.
